GENERAL:
All information contained on this Internet website is the exclusive
property of CIFELLI Corporation ("CIFELLI"). It may
not be copied, used, or altered in any way without
the express written consent of CIFELLI.
CIFELLI
will not assume responsibility for any losses or damages incurred as
a result of conducting business or communications via the Internet.
This includes but is not limited to:

WARRANTY for:
A. CIFELLI IP.
Intellectual Property (IP) are copyrightable works which include but
are not limited to software, feasibility studies, analytical reports,
etc. which are owned by CIFELLI
and sold under license¹ to our customers. These works are warranted from defects (non-conformance with
specifications) for ninety (90) days from the date of acquisition.
While the intent is to provide zero-defect solutions, CIFELLI
cannot guarantee that they are 100% without defect. CIFELLI
will not assume responsibility for any losses or damages incurred as
a result of any defects. However, CIFELLI
does guarantee that any defects will be met with a timely remedy at
no additional cost to you. CIFELLI
reserves the right to decide on what constitutes a sufficient
remedy. Such remedy may consist of a work-around, new-program,
code-patch, document-modification, any
combination of these, or other correction altogether.

¹The IP of parties other
than CIFELLI but whose licenses are sold by CIFELLI are covered under specific warranty
provided by its owner. For example, Microsoft Windows
XP Pro: while CIFELLI may sell you a license as an
standalone entity (retail box) or integrated in one of its product
offerings (OEM), all support (interim patches or service pack
downloads) would be obtained from Microsoft.
B. CIFELLI hardware.
Such hardware includes but is not limited to our
cBox,
cBook,
cNet
and cPEG
products which are sold outright² to our customers. While the
customer owns the hardware, at all times CIFELLI
retains ownership of the trademark, and may only be used by CIFELLI
only.

²In the event that a leasing entity (legally
our customer) acquires the product from CIFELLI to
finance the product's use for the end-customer, for the purposes of
warranty, the end-customer shall obtain support directly from CIFELLI
and shall not be required to go through the leasing entity for
technical or warranty related support.

Notebook Warranty |
All cBook
brand notebook computer systems come with a one-year limited
warranty. Some units are purchased with an optional extended
limited warranty. These warranties are for an additional 2 or 3
years. The standard limited one-year and optional extended
warranties for systems purchased in Canada or the U.S. are
described in this section. |

Two-Year, Three-Year Warranty |

CIFELLI manufactures
its hardware products from parts and components that are new in
accordance with industry-standard practices. CIFELLI
warrants that the hardware products it manufactures will be free
from defects in materials and workmanship. The actual limited
warranty period purchased is noted on your invoice. The warranty
term is one (1) year [or optional extended two (2) years or
three (3) years] beginning on the date of invoice, as further
described in the following text.
Damage due to shipping new products to you is covered under
this warranty. Otherwise, this warranty does not cover repairs
to the product if any part of it has been subjected to undue external
elements. So any indication of drops, liquid spills, compressive or impact
forces, abuse, misuse,
problems with electrical power may void the warranty. So may any
sign of tampering, servicing not authorized by CIFELLI,
usage not in accordance with product instructions or its design
intent, failure to
perform required preventative maintenance, and problems caused by
use of parts and components not supplied by CIFELLI.
This warranty
does not cover any items that are in one or more of the
following categories: software; external devices (except as
specifically noted); accessories, parts or components added to a
system after it is shipped from CIFELLI;
accessories, parts or components that are not installed in the CIFELLI
factory; or accessories, parts or components that are sold with
an expressed specific warranty in place of being covered under
this warranty.
on batteries and power supplies: EVEN IF YOU PURCHASED THE OPTIONAL
TWO (2) OR THREE (3) YEAR EXTENDED WARRANTY, ANY BATTERIES (CMOS
OR MAIN) AND POWER SUPPLIES, ARE COVERED IN THE FIRST YEAR ONLY.
CIFELLI will repair or
replace products covered under this limited warranty that are
returned to CIFELLI’s
facility. To request warranty service, you must contact CIFELLI
within the warranty
period. If warranty service is required, CIFELLI
will then issue a Return Materials Authorization
(RMA) number and notify you of the cost, if any, for return
shipping (& insurance if you want it). Unless pre-authorized
by CIFELLI, you must ship the
entire product (including power supply, batteries, hard drives,
carry cases, software, ...) back to CIFELLI
in their original or equivalent packaging,
prepay shipping charges to the return address of your choice,
and also prepay insurance for the shipment or accept the risk of loss
or damage during shipment. CIFELLI will
effect the repair as expeditiously as possible and ship the
repaired or replacement products back to you (freight prepaid).
on data: Before
you ship the product(s) to
CIFELLI
, back up the data on the
hard-disk drive(s) and any other storage device(s) in the
product(s). Remove any removable media, such as diskettes, CDs,
or PC Cards.
CIFELLI
does not accept liability for lost data or
software.

Specific Provisions:
CIFELLI owns all parts
removed from repaired products. CIFELLI uses
new and reconditioned parts made by various manufacturers in
performing warranty repairs and building replacement products.
If CIFELLI repairs or
replaces a product, its warranty term is not extended.
General Provisions:
CIFELLI MAKES
NO EXPRESS WARRANTIES OR CONDITIONS BEYOND THOSE STATED IN THIS
WARRANTY STATEMENT. CIFELLI DISCLAIMS
ALL OTHER WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED,
INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES AND CONDITIONS
OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SOME
PROVINCES (OR JURISDICTIONS) DO NOT ALLOW LIMITATIONS ON IMPLIED
WARRANTIES OR CONDITIONS, SO THIS LIMITATION MAY NOT APPLY TO
YOU.
CIFELLI’S
RESPONSIBILITY FOR MALFUNCTIONS AND DEFECTS IN HARDWARE IS
LIMITED TO REPAIR AND REPLACEMENT AS SET FORTH IN THIS WARRANTY
STATEMENT. THESE WARRANTIES GIVE YOU SPECIFIC LEGAL RIGHTS, AND
YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM PROVINCE TO
PROVINCE (OR JURISDICTION TO JURISDICTION).
CIFELLI DOES
NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH IN THIS
WARRANTY STATEMENT OR LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL
DAMAGES, INCLUDING WITHOUT LIMITATION ANY LIABILITY FOR PRODUCTS
NOT BEING AVAILABLE FOR USE OR FOR LOST DATA OR SOFTWARE. SOME
PROVINCES (OR JURISDICTIONS) DO NOT ALLOW THE EXCLUSION OR
LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE
PRECEDING EXCLUSION OR LIMITATION MAY NOT APPLY TO YOU.
These provisions apply to CIFELLI’s
limited one-year, two-year, and three-year warranty. For
provisions of any service contract covering your system, refer
to your invoice or the separate service contract that you will
receive.
In any instance in which CIFELLI issues
a RMA number, CIFELLI
must receive the product(s) for repair prior to
the expiration of the warranty period in order for the repair(s)
to be covered by the warranty.

Bad Pixels:
If, within seven (7) calendar days of receiving your
notebook computer, you find defective pixels on your LCD screen, you
may be eligible to return your computer for replacement in
accordance with the following rules. If so, contact us for an
RMA number.
